1. Service Description:  The service you are paying for is a Website Subscription Plan that is licensed on a monthly basis. In addition to receiving the website license on a monthly basis,  you also receive website hosting included with the monthly fee as well. All website updates, backups, maintenance, server updates, etc. are the responsibility of PestControlWebsites.net.
2. Design Ownership:  The website design is owned by PestControlWebsites.net and you are simply licensing the design on a monthly subscription basis. If you choose to cancel the contract, the website design, layout, photos, content and functionality are retained by PestControlWebsites.net. The only exception is client provided content. If you write content that you want placed on the website, provide a logo, and/or upload your own background image, you are free to take this content with you to your new website.
3. Domain Ownership:  If you have and we use a domain that you own, the website domain is not owned or controlled by PestControlWebsites.net. Your domain registrar will charge a annual fee for domain ownership which is your responsibility. Your domain will simply be pointed to our server where we host your website, but you will always control and own your domain name.
4. Free Subdomain: If, instead, you choose to utilize our free subdomain (yourpestcontrolcompany.pestcontrolwebsites.net), the license for the subdomain is included in the monthly website license agreement. Ownership of the subdomain will not convey.
5. Plan Inclusions:  Your plan includes the website design license, website hosting, platform maintenance, platform updates, server updates, security protocol, and daily website backups. Your plan includes free content updates on a quarterly basis. Please see “content” below. Your plan includes utilizing the Stripe payment gateway. Other payment options may be used, but these are considered customization time and would be billed as such.
6. Plan Exclusions:  Your plan does not include adding new pages, changing the layout or design elements, changing payment processors, or phone calls to discuss content / customization. Any work that is not part of the plan inclusions, as determined by PestControlWebsites.net, will be billed at a rate of $50/hour. Changing your mind after the work has been completed is also not included, even if you change your mind and pick something that is included in the plan. For example, if you choose green for the color scheme on your new website, and we do the work, and then you decide to change your mind shortly after, we will bill at a rate of $50/hour for updating the website. Of course, we require preapproval for any additional billing. We’ll never surprise you with extra charges or fees.
7. Content:  The content, or text found on the website, will be adjusted to include your company's specific information. Or, we can replace our generic content with content that you provide. Either option will be done at no charge when we build your new website and can also be updated quarterly at no charge.  However, PestControlWebsites.net will not write additional content for you. If your content requires us to change the layout to make things fit, this is considered customization and will be billed at $50/hour. All requested changes and text provided must be done via email.
8. Contract Term:  The contract term is month to month. All terms of this agreement go into effect starting the moment you sign the agreement until cancelled in writing. There will be no refunds of any kind.
9. Deposit:  There is no deposit required.
10. Billing Start Date: The billing start date is the date you submit our Get Started Form. You cannot delay the billing start date for any reason, including sending us updates and then claiming the website is not “ready” or waiting on Stripe setup.
11. Monthly Payment:  Your payment is due monthly, on the same day as your billing start date. There will be no additional charges unless specifically authorized by you and no refunds of any kind. All payments will be made via credit card and will be automatically billed each month. No payment plans, checks, or other forms of payment will be accepted. Automatic payment is required.
12. Late Payments:  If your credit card payment is declined and/or your payment is not received for any reason, we reserve the right to take down your website after 7 days past due. The account must be current for your website to be re-activated.
13. Branding:  The “Powered by PestControlWebsites.net” link in the footer is a requirement. This link does more than promote PestControlWebsites.net. It also makes it easy for anyone to get ahold of us should there be a problem with your website.
14. Admin Panel Access:  We do not allow access to the WordPress admin panel or SFTP panel to anyone for any reason.
15. Buy out pricing:  All of our website designs, including all elements, are available for purchase at a cost of $1,500 per design.  However, the buy out price only includes a single use on your personally owned pest control business. You cannot resell our website designs. Past payments will not be credited towards this $1,500 cost to buy out the website design. Hosting is available, but not included in the $1500 cost.
16. Contract Termination:  To terminate your contract, simply email PestControlWebsites.net that you would like your contract to end. We will cancel the automatic payments that process each month. We require a 10 day notice to assure that you will not be charged for the next billing date. There will be no refunds for a partial month.
17. Design Theft: If you cancel your contract, you understand and agree that you cannot use any images that we provided and used in our designs in your new website. In addition, you cannot copy the website in any way. If your new website is substantially similar to our design, uses our content, or if you use any images from our designs, you understand and agree that you will be held immediately liable for the $1,500 buy out pricing.
18. Limitation of Liability:  You agree to hold PestControlWebsites.net, it’s officers, owners, shareholders, employees, affiliates, and parent companies harmless from any loss of business due to website downtime, server issues, or any other technical issues arising for any reason. In addition, you agree that the maximum loss sustained while utilizing the service is the monthly fee charged by PestControlWebsites.net. Note:  No customer data, credit cards, customer details or any other important information is stored on the website.
19. Dispute Resolution: The terms of this Agreement and/or any dispute between the Parties shall be governed by the substantive law of the State of Arizona. Each party irrevocably agrees that any suit, action, or proceeding arising out of or relating to this agreement shall be exclusively instituted in any court located in Apache County, Arizona.
20. Tech Support:  We do not provide any type of tech support services. Our Monthly Website Subscription Plan does not include helping you figure out how to use your email service, update your Facebook page, or anything else that is tech support related. If you need help in any tech related area, email us. We will try to accommodate you.
21. Marketing: Marketing services are not included with your Monthly Website Subscription Plan. While our pest control templates are high quality and optimized for SEO, you will not automatically get organic traffic to your website without marketing it. Leads will not start coming in until you spend the time or money on marketing to drive traffic. The Monthly Website Subscription Plan we provide does not cover updating your URL on Facebook, Linkedin, etc. or any external website. Those services would be part of an internet marketing plan and would fall outside of the scope of this agreement.
